A disposable vape is a single-use electronic cigarette designed for convenience and simplicity. Unlike rechargeable vapes, disposable vapes come pre-filled with e-liquid and have a built-in battery that does not require charging. Once the e-liquid is depleted (or the battery dies), the entire device is discarded. These vapes are typically compact, lightweight, and available in various flavors, making them a popular alternative to traditional cigarettes and rechargeable vaping devices. Their ease of use has made them particularly attractive to first-time users who want to try vaping without too much up-front investment and prefer a simple, hassle-free vaping experience.

Disposable vapes have gained immense popularity for several reasons. Their biggest appeal is their convenience, as they do not require refilling, charging, or coil replacements. Users can simply inhale and discard the device once it runs out, making them an ideal choice for those who want a low-commitment vaping option. Their small size and portability make them easy to carry, and their discreet design allows for vaping in various settings without drawing too much attention. Another major factor behind their success is the wide variety of flavors available, ranging from fruity and sweet options to traditional tobacco and menthol. This diverse flavor range has contributed to their widespread appeal, particularly among younger consumers. Additionally, disposable vapes are often more affordable upfront compared to reusable devices, as they do not require additional accessories or ongoing maintenance. Their nicotine delivery system, which often uses nicotine salts, provides a smooth and satisfying experience, closely mimicking the sensation of smoking a cigarette. This makes them a preferred option for smokers looking to transition away from traditional tobacco products. Despite their popularity, disposable vapes have faced significant regulatory challenges in both the UK and the USA, albeit for different reasons.

United Kingdom (UK)

In the United Kingdom, the government has announced a forthcoming ban on disposable vapes as part of efforts to address environmental concerns and reduce youth vaping. These single-use devices contribute to a growing waste problem, as they contain plastic, lithium-ion batteries, and electronic components that are difficult to recycle. The UK government is also concerned about the increasing number of young people taking up vaping, often attracted by the colorful packaging and appealing flavors. In response to the ban, manufacturers have introduced rechargeable alternatives, such as “Big Puff” vapes, which allow users to refill and reuse devices while technically complying with new regulations. Chinese brands, such as Hayati, Pixl, SKE, and Elfbar, are flooding the UK market with adapted throw-away vapes in sweet and fruity flavours that could circumvent a Government ban on disposables.

These companies are now selling 3 million so-called “Big Puff” vapes each week in Britain. Altough the volume is brlow the 5.3 million per week peak sales of single-use vapes, the total quantity of nicotine consumed is much more. In short, e-cigarette manufacturing plants in Shenzhen, the vape capital of the world, are more busy than ever. Critics argue that vapes, with rechargeable batteries and refillable 10ml pods, could undermine the effectiveness of the disposable ban as they continue to offer a high nicotine intake with extended usability. These click into devices refill the tanks’ 2ml legal capacity five times while extending the life of any unit past the new official disposable definition of “single use only”. The colourful Big Puff vapes – which include flavours such as Blue Razz Gummy Bear, Cotton Candy and Cherry Pop – comply with regulations by using separate components, with a maximum strength of 20mg. They are advertised to be “in full compliance with the New UK Law”.

Some Big Puff vapes provide up to 15,000 puffs (750 cigarette equivalent) before the devices are thrown away – while disposables average about 600 puffs per unit (30 cigarette equivalent). For instance, Lost Mary Big Puff vape (2+10ml e-liquid; 6,000 puffs) is retailed as low as 3 for £23. Assuming 20 puff-a-cigarette conversion rate, this offer implies a price of £0.50 per cigarette-pack equivalent – in a country where the average price of a pack of 20 cigarettes is £16.45. All in all, Big Puffs work out to be even more cost-effective than the one-use products set to be banned in the UK on June 1, 2025. Retailers reported a drop in disposable vape sales since the Government announced the June ban, but a spike in sales of “legal” Chinese alternatives. All in all, vaping sales increased by 37% in the UK in 2024, from 9.9 million units per week to 13.5 million units in 2024. About one in eight, or 12%, of UK adults are vaping and the sector grossed £1.325billion turnover in tracked channels alone in 2024.

Critics call for an amendment to the Tobacco and Vapes Bill to limit the size of refill tanks and prevent adaptations that could circumvent the disposables ban. For instance, it should not be allowed for refill containers to be attached to a device post purchase to increase its capacity beyond the legally accepted limits. The Tobacco and Vapes Bill is currently at report stage, before its final Commons debate. It will then progress to the House of Lords.

Nevertheless, agile Chinese manufacturers know how to stay one step ahead of government plans – always thinking what the next move will be, and reinvent, redesign and recalibrate their factories to mass produce the designs that can stay compliant with any law change. Many production lines rely on hand assembly for certain components, alongside automated production – allowing for flexibility in adapting to new designs.

United States (USA)

In the United States, the regulatory focus has been on restricting flavored vapes and enforcing compliance with the Food and Drug Administration (FDA) regulations. The FDA has been actively cracking down on unauthorized vaping products, particularly those marketed in flavors appealing to younger audiences. Many disposable vape brands have faced regulatory or legal challenges due to their non-compliance with federal tobacco laws. Nevertheless, enforcement remains a challenge and a large market of illegal vapes exists. In response to the U.S. Food and Drug Administration’s (FDA) crackdown on unauthorized e-cigarette imports, several vape companies have modified their business strategies to continue operations. Notably, Chinese firm Heaven Gifts, owner of Elf Bar and Lost Mary, shifted its U.S. operations of the Lost Mary brand to a British Virgin Islands entity, Wonder Ladies Limited, aiming to circumvent FDA restrictions. Similarly, Texas-based Ludicrous Distro ceased selling its own unauthorized products and began distributing other unlicensed devices. These maneuvers complicate the FDA’s efforts to regulate the market, as companies alter their business models, legal structures and branding to evade detection.

The FDA has approved only a limited number of products (34 out of millions of applications) from major tobacco companies, leading to industry criticism that restrictive policies hinder smokers’ access to cigarette alternatives. Additionally, British American Tobacco has filed complaints against multiple companies for unfair competition and patent infringements, highlighting the ongoing tensions in the competitive US vape market. Similar to the UK vape market, we observe the rise of high-capacity and rechargeable vaping devices in the U.S. with consumers starting to shift toward alternatives that offer extended use. All in all, the debate in the U.S. remains centered on balancing harm reduction for adult smokers while preventing youth addiction to nicotine, a challenge that continues to shape the evolving regulatory landscape.

As governments in both the UK and the USA attempt to tackle the issues surrounding disposable vapes, the vaping industry continues to adapt to new restrictions. Whether through outright bans or increased regulation, policymakers face ongoing challenges in curbing youth access while ensuring that adult smokers have access to less harmful alternatives. The future of disposable vapes remains uncertain, as both markets seek to find a balance between public health concerns, environmental responsibility, and consumer demand.
