July 2026: New Australia Regulations Ban Personal Importation of Nicotine Pouches

The Australian Government has established new regulations to restrict access to nicotine pouches, citing concerns over public health and the growing appeal of these products to younger demographics. Under the new rules, which take effect on July 24, 2026, individuals will be prohibited from importing nicotine pouches via the Personal Importation Scheme, which previously allowed personal imports under specific conditions. Furthermore, access through the Special Access Scheme and the Authorised Prescriber Scheme – both of which allow health practitioners to prescribe unapproved therapeutic goods when clinically justified – will be ceased for these products. The regulations also ban pharmacists and other healthcare practitioners from compounding nicotine pouches for individual use.

The Therapeutic Goods Administration (TGA) has indicated that the changes are a response to mounting public health concerns and the increasing availability of nicotine pouches in the Australian market. The regulatory body noted that the updated measures will enhance the ability of the TGA and partner agencies to detect and prevent unlawful importation, advertising, and supply, while ensuring that the public has access to approved, evidence-based options for managing nicotine dependence.

Health authorities emphasize that nicotine is a highly addictive substance that can affect brain development in adolescents and lead to long-term dependence. The TGA pointed out that there is limited clinical evidence showing that nicotine pouches assist with smoking cessation, and that their long-term health effects remain unverified. Additionally, these products are associated with potential safety issues, including highly variable nicotine concentrations, contaminants, and misleading product labeling.

August 2025: TGA issued an official statement on nicotine pouches

Following the surge in the advertising and online sales of nicotine pouches, Therapeutic Goods Administration (TGA) issued an official statement: nicotine pouches are prescription only medicines and are illegal in Australia unless prescribed1. TGA notes that nicotine pouches are considered therapeutic goods and there are no nicotine pouches approved in Australia by the TGA – which means that nicotine pouch products have not been tested for safety, quality, or effectiveness. Although nicotine pouches are often marketed as a “smoke-free” or “tobacco-free” alternative to smoking or vaping, TGA underlines that there is little evidence that they are effective in helping people quit smoking or vaping or in managing nicotine dependence.

Under Australian law, nicotine pouches cannot be sold by retail outlets or tobacconists, cannot be advertised, cannot be imported or sold without TGA approval or a valid written authority or prescription from an Australian health practitioner. Some states or territories may have additional restrictions: for example, in South Australia, nicotine pouches are banned under new tobacco and e-cigarette legislation. Under the Therapeutic Goods Act 1989, Advertising and supply offences are subject to significant penalties – which includes imprisonment for up to 5 years, a fine of up to A$1.32 million, or both. Further penalties may also apply under state and territory medicines and poisons laws.

TGA notes that side effects linked to nicotine pouches include:

– fast heart rate and high blood pressure

– nausea, dizziness, and headaches

– dry mouth and strange jaw sensations

– mouth sores.
